REGULATIONS
F.P.H.U. DREWEKS online shop regulations are valid from 15.10.2017 r.
§ 1. GENERAL PROVISIONS
1.1. The Regulations of using the online store(hereinafter referred to as the Regulations), , located at http://www.dreweks.eu/sklep.php (hereinafter referred to as the Shop) determine the rules of using the Shop.
1.2. The owner of the Shop (hereinafter referred to as the Seller) is:

§ 2. USING THE SHOP
To place an order with the Shop it is necessary to have a device which allows browsing websites and to have an electronic e-mail address.
2.1. Orders can be placed via the shopping Cart available at http://dreweks.pl/sklep.php
or e-mail.
2.2. Orders via shopping Cart and e-mails can be placed 24 hours a day, 7 days a week for the whole year.
2.3. To place an order, a Customer must create a Customer Account by filling in a Registration Form and providing following data: name and surname, e-mail address and password. When placing an order the Customer is obliged to provide as well the following information: place of residence / shipping address, phone number, symbol and name of ordered Product, quantity, preferred way of shipment, preferred way of payment.
2.3.1. The Seller is entitled to withdraw the order if the Customer has given incorrect, incomplete or false personal data.
2.4. The Customer who intends to make an order in the Shop is required to:
a. add Products to the Cart by clicking “Add to Cart” button;
b. log in to the existing Customer Account using e-mail address and password (if Customer Account is already created) or register by creating the new Customer Account;
c. read the Regulations and accept its provisions as well as agree on the personal data processing for the purpose of the Order;
d. pick up the delivery method (the delivery cost will be visible in the Order Form)
e. pick up the way of payment;
f. confirm the order.
When the Customer has finished selecting the Products to the Cart, it is possible to check the content of the Cart and either modify the Cart (quantity of Products, removing Products), continue the shopping or finally confirm the order prior to payment by clicking on the “Proceed to checkout” button.
2.5. The Customer may track the current status of the order in the Shop by accessing the “Order history and details” section in the personal Customer Account.
2.6. Placing an order means submitting the offer by the Customer in the meaning of Art. 66 of Polish Civil Code. The sales contract is concluded as soon as the Customer receives an e-mail with the Seller’s confirmation of the order.
2.7 Orders will be processed once a relevant payment is registered. The Seller is entitled to withdraw from the offer if an ordered Product is temporarily unavailable. In this case the Customer will be informed immediately and has a right to either cancel or change the order.
2.7.2. By accepting the Regulations the Customers agrees to receive an electronic invoice. The invoice is available in Customer Account and can be downloaded once the ordered products are dispatched. The Customer is informed via e-mail about the fact. Paper invoices are issued only at an explicit request of Customer.
2.8. In case of lack of payment within 10 days after the order was placed the Seller is entitled to cancel the order.
§ 3. DELIVERY
3.1. Orders can be shipped within Poland as well as abroad. The shipping address should be given by the Customer when placing an order.
3.2. The Customer can pick up the following shipping methods:
• DPD parcel,
• Inpost
• self collection in Białka 642, 34-220 Maków Podhalański.
The self collection of Orders is possible within the following days and hours:
Monday to Friday: 8am - 4pm CET
Saturday: 8am - 12pm CET (on Saturdays additional arrangement needs to be done prior to the visit– please send an e-mail or call to confirm the collection possibility on Saturday)
We are closed on Sundays and Public Holidays.
3.3. The shipping cost depends on the Order’s volume and it’s weight.
3.4. If the delivery address is within Poland the shipping cost is usually calculated and provided in the Order Form when placing and order. In case the shipping cost is not provided, the Customer shall contact the Seller before making the payment to agree on the shipping cost.
3.5. The shipping cost outside of Poland are agreed individually – via e-mail or phone.
3.6. The order is prepared and shipped right after receiving the payment, not later than fourteen (14) days from the date of payment.
3.8. Upon delivery, the Customer should check:
a. if there are any mechanical damage to the package or products,
b. the completeness and compatibility of all products with the order.
The Customer is required to document any damages to products and package in a complaint protocol provided by the carrier and send its copy to the Seller as well as notify the Seller within 2 days about any other inconsistencies in the order (missing or wrong products) using a Complaint Form.
3.9. The Seller is responsible for defects according to polish civil code (Kodeks Cywilny).
§ 4. PRODUCTS PRICES AND PAYMENT METHODS
4.1. The prices of the Products are set in the Polish Zloty (PLN) and include tax (gross prices).
4.1.1. The Customer may pay in foreign currency upon a request at the exchange rate indicated by the Seller.
4.2. The Customer can choose between the following payment options:
a. bank transfer,
b. Dotpay,
c. cash when self collection
d. cash on delivery.
4.2.1. Choice of payment method proceeds by selecting the appropriate option in the Order Form.
4.3. The Shop reserves the right to change the prices of the Products available in the Shop, introduce and remove Products, conduct and cancel promotions on the Shop's websites or alter the promotions.
§ 5. WITHDRAWAL
5.1. The Customer (in the sense of the polish Civil Code – an individual, not a company, purchasing the Products for the purpose not involving the occupation or a business) may withdraw from the sales contract for any reason by submitting appropriate statement in writing within fourteen (14) days from the Product receipt. The Seller has to be notified about the fact on the Withdrawal form.
5.2. The form should include:
- date of Sales Contract / products receipt
- name, surname, address of Customer,
- name, symbol, quantity of purchased Products
and the receipt/invoice should be attached.
5.3. After receiving the Withdrawal Form the Seller will confirm its receipt.
5.4. In case of withdrawal from the Sales Contract by the Customer, the Sales Contract is considered as not concluded. The Products should be immediately sent back to the Seller, to the address: F.P.H.U. Dreweks, Białka 642, 34-220 Maków Podhalański. The Product should be returned the latest within fourteen (14) days after providing the Withdrawal form to the Seller. The costs of packaging and shipping the Products back to the Seller are covered by the Customer. The returned products will only be accepted by the Seller if they are complete, unused and undamaged.
5.5. After inspecting the return, the Seller will issue a credit for the merchandise (including any applicable sales tax) to the original payment method used. Any shipping charges from the order will not be refunded. The processing of the money refund will take up to 2-3 weeks after receiving the Products.
§ 6. COMPLAINTS
6.1. The Seller is responsible to the Customer for any product defects in line with the Polish Civil Code.
6.2. Any complaints shall be submitted in writing on the Complaint Form to the e-mail: reklamacje@dreweks.eu .
6.3.1.The complaint should include at least the name and type of Product (with symbol), an indication of the date on which the defect was discovered, the Customer details, brief description of the defect and its pictures
6.3. To investigate the complaint in some cases the Product should be returned to the address of the Seller: F.P.H.U. Dreweks, Białka 642, 34-220 Maków Podhalański, together with the receipt / invoice. The Product should be returned only upon an explicit request of the Seller after initial investigation of the complaint.
6.4. The Seller shall consider the complaint within 14 days. The Seller sends the complaint reply to the e-mail address indicated by the Customer. In case of no address provided, the reply will be sent to the e-mail address used while creating the User Customer Account or placing an order.
6.5. The purchased Product may differ in terms of appearance (e.g. color of the Product, the proportions of the Product) from the images displayed on the Shop’s website. Differences resulting from hardware settings do not constitute grounds for the complaint of the purchased Product
§ 7. Copyrights
7.1. Copyrights to any content posted on the Shop website are entitled to the Seller and shall be protected under the Act of 4 February 1994 on Copyright and Related Rights (Dz. U. z 1994 r., Nr 24, poz. 83)
§ 8. OTHERS
7.1. In the Shop Seller enables free services: using the Order Form, creating a Customer Account in Shop, using the Newsletter service.
7.2. The services offered in point 7.1. are offered 24 hours a day for the whole week/year.
7.4. The Newsletter includes the commercial information and may have promotional and advertising content. The Customer is given the option to register for Newsletter when placing an Order. The Newsletter is sent to the e-mail address given by the Customer when registering and is sent only to those Customers who registered for it.
§ 9. FINAL PROVISIOS
8.1. The Sale Contract is concluded in accordance with the Polish law. Any dispute arising out of the Sale Contract shall be settled by the competent local court of general jurisdiction, i.e. the court having jurisdiction over the respondent's seat or having jurisdiction over the place of fulfilment of the agreement.
8.2. The regulations of the Polish law are applied to all matters not covered in this Regulations.
8.3. The Seller is entitled to change the Regulations. Amendments to the Regulations oblige from clearly defined moment and will appear on the Shop website http://www.dreweks.eu/sklep.php, to the extent that does not infringe the rights acquired by the Customers.
8.4. Placing and order in the Shop means acceptance of above Regulations.
